PI - Likely Time Scales

Welcome We deal withPersonal InjuryContact Us

1 to 2 Weeks. Following a brief consultation if we decide to investigate your claim, we will need to obtain further details from you in order to provide free initial advice. We will also need to discuss various funding options available to you.

2 to 4 Weeks. We will arrange appropriate funding for you. The length of time will depend on the type of funding to be arranged.

1 to 4 Months. We will obtain relevant witness evidence and pertinent documentation in order to put forward a formal Letter of Claim to the Defendant(s) in your case. The length of time will depend on the involvedness of the issues.

4 to 6 Months. When the Letter of Claim is forwarded to the Defendant(s), they (or their insurers) will have 3 months in which to investigate your claim and confirm whether or not liability is admitted.
If the Defendant(s) deny liability we will have to re-examine your claim. This normally requires consultation with a barrister and or an expert. If we decide that it is in your best interest to proceed further with your claim (and funding will not be an issue) then we will issue court proceedings against the Defendant(s) forthwith and your case will progress according to a court timetable and it could take up to three years.

6 to 18 Months. If liability is admitted, we will instruct an appropriate expert to prepare a report following his or her examination of your injuries. The length of time between our instructions and your examination will depend on the expert’s availability. Upon receipt of a report we will need to ascertain accurate value of your claim. We will have to research in to already decided cases similar in nature and extent to your case. This can either be relatively straightforward if the expert has been able give a final prognosis (in which case we will begin to negotiate an out of court settlement with the Defendants’ insurers on your behalf) or convoluted if the expert has not been able to give a final prognosis and your injuries require further treatment or if he or she has suggested another report of a different nature or if we need to calculate a claim for future care needs and or loss of earnings. In either case if an out of court settlement cannot be reached, court proceedings may have to be issued at this stage and the length of time your case could take will then be determined by the court.
